As instituições estão localizadas em Barra do Riacho, no município de Aracruz, Espírito Santo. Prioriza o olhar sobre/com as crianças negras pelo fato desse grupo compor a maioria dos alunos das escolas públicas brasileiras e estarem em desvantagem em relação à garantia de direitos e mais suscetíveis às formas explícitas ou veladas de discriminação racial. Compreende as desigualdades na perspectiva bidimensional da justiça, na qual a raça e a classe convergem e se entrecruzam como demandas de distribuição e reconhecimento. A investigação buscou compreender as dinâmicas em torno da “Captura” e encaminhamento das crianças ao Conselho Tutelar e das trajetórias das crianças negras nessas instituições por meio de relatórios. A partir do estudo de caso, as observações, as análises dos relatórios e entrevistas assinalam para a disciplinarização e normatização dos sujeitos e para a existência de um racismo institucional. Os dados de escolarização das crianças encaminhadas ao Conselho Tutelar e os atravessamentos sociais analisados por cor/raça indicaram assimetria racial na permanência das crianças negras na escola. Recortes de trajetórias de crianças negras atendidas também apontaram a criança negra no limite de compor dados de violência letal na adolescência, quando analisados junto aos índices nacionais. Partiu-se do princípio de que o Estado deve garantir a todas as crianças, por meio dos equipamentos públicos e das políticas públicas, os direitos constitutivos das crianças e adolescentes. (ECRIAD). Vê-se na implementação da Lei 10.639/03, uma das possibilidades de descolonizar o direito à educação. A aposta na participação das crianças e no reconhecimento de sua pluralidade sintoniza com a busca de garantia da permanência de todas as crianças na escola e a superação do racismo institucional evidenciado.This thesis has as its background the analysis of the experiences of two schools, whose children are ‘’captured’’ and sent to the Guardianship Council. The institutions are localised in Barra do Riacho in the city of Aracruz, state of Espírito Santo. It is mainly focused on the look on/with black children, related to the fact that this group compounds the majority of students that are in public schools in Brazil and are in disadvantage as regards the guarantee of rights and also more susceptible to explicit or veiled forms of racial discrimination. It comprehends the inequalities in a two-dimensional perspective of justice, in which race and class converge and intersect as distribution demands and recognition. The study aimed to comprehend the dynamic that surrounds the ‘’Capture’’ and the referral of children to the Guardianship Council and also the trajectories of the black children in these institutions through reports. From the case study, the observations, reports analysis and interviews point to the disciplining and regulation of the subjects and to the existence of an institutional racism. Enrolment data of the children referred to the Guardianship Council and the social crossings analysed by race/ colour indicated racial asymmetry in the permanence of black children in school. Scraps of the trajectory of the attended black children also pointed the black child as in the edge to compound the lethal violence data in adolescence, when analysed together with the national indices. It started from the principle that the Estate must guarantee to all children, through public facilities and public policies, the constitutive rights of the child and adolescent (ECRIAD). It is seen in the implementation of Law 10.639/03 one of the possibilities to decolonise the right to education. The focus on the involvement of children and the recognition of its plurality agree with the search for guaranteeing the permanence of all children in school and overcoming the evidenced institutional racism
